Class Action Waiver

Neither you nor we will seek to have any dispute heard as a class action or in any other proceeding in which either party acts or proposes to act in a representative capacity. No proceeding will be combined with another without the prior written consent of all parties to all affected proceedings.

Non-replaceable Free Course Offerings
In the event that Fitterpreneur LLC offers complimentary courses, training sessions, or seminars in conjunction with its primary services, participants are hereby notified that attendance at these free offerings is their sole responsibility. Should a participant fail to attend any such complimentary courses, Fitterpreneur LLC is under no obligation to offer a replacement or alternative session. These free courses are offered as a non-compensatory, additional benefit and do not entitle participants to any subsequent claims for missed sessions.

Jurisdiction and Governing Law

These Terms are governed and interpreted pursuant to the laws of the State of California, United States of America, notwithstanding any principles of conflicts of law. Any action or proceeding arising from or relating to these Terms must be brought in a federal or in the state and federal courts in La Jolla, California. You hereby irrevocably consent to the exclusive personal jurisdiction and venue of such courts.

Waiver of Jury Trial

You acknowledge and agree that any controversy or claim arising out of or relating to these Terms, shall be settled by the state or federal courts located in California. If such claim is not subject to being brought in said courts, then you agree to waive any right you may otherwise have to trial by jury.

Changes to Terms

We reserve the right to update or change these Terms at any time without prior notice. Your continued use of the Site after any changes to the Terms constitutes your acceptance of the changes. It is your responsibility to review these Terms for changes when accessing the Site.

General

The failure of us to exercise or enforce any right or provision of these Terms shall not operate as a waiver of such right or provision. Any waiver of these Terms by us must be made in writing and signed by an authorized representative of Fitterpreneur LLC.

You may not assign or transfer these Terms or your rights under these Terms without our express prior written consent. We may assign, transfer or delegate any of our rights and obligations under these Terms without consent.

Should any part of these Terms be held invalid or unenforceable, that portion shall be modified to achieve the objective of the original provision to the fullest extent permitted by law and the remaining provisions of these Terms shall remain in effect.

These Terms constitute the entire agreement between you and us with respect to this Site. It supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written related to this Site.

Non-Refundable Fees

Any application, registration or other fees paid or payable to access our educational courses, webinars, coaching programs or other paid services are non-refundable. No refunds shall be offered under any circumstances including but not limited to, your election to discontinue participation or our termination of your access.

Pricing Changes

We reserve the right to change our fees or pricing at any time. Published prices do not guarantee availability or represent an offer to sell. We are not responsible for errors in pricing or promotion. Additional restrictions may apply. We make no price guarantees or price protection. You accept full responsibility for and release us from any claims related to pricing or promotions.

No Endorsement

We are not affiliated with or endorsed by Facebook or any other social media platform, search engine, app store or marketplace where our Site and services may be advertised, offered or made available. Any use of the Site via third-party sites or platforms is at your own risk.

Job Interview Guarantee

Fitterpreneur LLC provides a singular, guaranteed job interview opportunity within six months following certification, exclusively for positions aboard cruise ships as fitness professionals. This one-time interview guarantee is expressly limited to these specified positions and does not extend to any employment opportunities or interviews with other employers or partners associated with or independent of Fitterpreneur LLC. Eligibility for this guaranteed interview is strictly contingent upon the applicant meeting the requisite qualifications and their performance throughout the hiring process.

Third Party Recruitment

When an applicant receives a job interview through Fitterpreneur's guarantee, Fitterpreneur is not involved in the third party employer's hiring decisions or processes. Fitterpreneur does not influence or give preference to any candidates. Hiring decisions are made solely by the employer based on their policies.

Anti-Discrimination

Fitterpreneur does not tolerate any discrimination based on race, color, religion, sex, national origin, age, disability, genetic information, pregnancy, veteran status, sexual orientation or any other protected characteristics. Our programs are open to all qualified candidates regardless of such factors.

Job Placement Disclaimer

While Fitterpreneur provides training, certifications and resources to equip candidates for fitness roles, we do not guarantee job placement with any employer. Securing a job is dependent on the applicant's qualifications, interview performance, and hiring needs of employers.

Limitation of Liability for Ongoing Career Success
Upon successful completion of certification, training, or other services provided by Fitterpreneur LLC, the applicant's subsequent career success is solely determined by their individual efforts and capabilities. Fitterpreneur LLC makes no representations, warranties, or guarantees regarding any specific level of post-certification achievement or success. Following the issuance of certification, Fitterpreneur LLC’s obligations regarding career support and guidance cease.
